Oswaldtwistle man sees police assault charge discharged
A man has seen his case thrown out of court by a judge, prompting police to look into a complaint.
Adam Brooks, 30, of The Cooperage, Oswaldtwistle, had been charged with assaulting a police officer in October 2023.
He pleaded not guilty to the offence and at a hearing on January 24 at Preston Crown Court, before the trial could take place Mr Brooks saw his case discharged by the judge, and he was found not guilty.
Mr Brooks said the judge drew concern to CCTV which was due to be used as evidence in the case, which he said showed him being assaulted at Greenbank Police Station in Blackburn, and he said the judge was critical of both Lancashire Constabulary and the Crown Prosecution Service during the hearing.
The court confirmed Mr Brooks was found not guilty and the judge had discharged the case.
Lancashire Police was approached for comment on whether an investigation into the officer and the incident at the police station was taking place.
A spokesperson said: “A complaint has been received and we are looking into it.
“It would be inappropriate to comment any further at this time.”
Mr Brooks said the judge ordered the CPS to investigate why the case was ever brought to court, and said he is looking into the options available to him, including possible civil action.
